The Promoter

1. The promoter is Elanco New Zealand, 106 Wiri Station Road, Manukau, Auckland 2104, New Zealand (company no. 7851116) (Promoter).

Terms and Conditions of Entry

2. Information on how to enter the Seresto™ WIN an $800 New World Gift Card Promotion (Promotion) and the Prizes form part of these terms and conditions.

3. Entry into the Promotion is deemed acceptance of these and any other applicable terms and conditions (together the Terms and Conditions). Any entry not complying with the Terms and Conditions is invalid.

How to Enter and Eligibility

4. The Promotion is open to New Zealand residents who are aged 18 years or over (Participant) and purchase one or more of the Qualifying Products (defined below) from a participating veterinary clinic, pet retailer or an authorised online retailer in New Zealand during the promotional period of 2nd September 2024 to 11:59 pm on 3rd of November 2024 (Promotion Period). The qualifying products are Seresto™ Flea & Tick Collar for Kittens and Cats, Seresto™ Flea & Tick Collar for Dogs less than or equal to 8 kg, and Seresto™ Flea & Tick Collar for Dogs Over 8 kg (Qualifying Products).

5. Employees and directors of the Promoter and (if applicable) the Promoter’s agency utilised in running the Promotion, and the immediate families of employees and directors of the Promoter and agency (if applicable) are not eligible to enter.

6. Participants must enter the Promotion online during the relevant Promotion Period at www.winseresto.co.nz by completing the entry form, including entering personal details (name, email and phone number), identifying which Seresto™ collars have been purchased, the quantity of Seresto™ collars purchased and upload a copy of their receipt. The receipt(s) must be retained as proof of purchase and must be produced by a Prize-winner at the Promoter’s request.

7. Multiple entries into the Promotion during the Promotion Period are permitted, provided that a Qualifying Product has been purchased for each entry and each entry is completed correctly.

8. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter for any reason by the relevant Closing Time and Date (defined below). Such entries will be deemed invalid.

9. The Promoter reserves the right, at any time, to verify the validity of entries and to request proof of a Participant’s eligibility (including a Participant’s identity, age and place of residence). If there is a dispute as to the identity or eligibility of a Participant, the Promoter reserves the right, in its sole discretion, to determine same. The Promoter may (in its sole discretion) disqualify any Participant who submits an entry that is not made strictly in accordance with the Terms and Conditions or tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

Promotion

10. The Promotion commences at 9am on Monday 2nd September 2024 and closes at 11:59pm on Sunday 3rd November 2024 (Closing Time and Date) (Promotion Period). Entries must be received by the Promoter by the Closing Time and Date.

11. The Prize draws will take place at 103 Onehunga Mall, Onehunga, Auckland 1061 on 11 November 2024 (Draw Date). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Each Prize-winner (Prize-winner[s]) will be drawn randomly and separately and will be the first eligible eight correctly completed entries drawn on the Draw Date.

12. The Prize-winners will be contacted by the Promoter (or their agent) within ten (10) business days of the Draw Date by telephone or email using the contact details provided on the Promotion entry form online and their names will be published online at https://mypetandi.elanco.com/nz on 12 November 2024. (A business day means a day that is not a Saturday, Sunday nor a public holiday in Auckland, New Zealand.)

13. If a Prize is unclaimed because a Prize-winner cannot be contacted within fifteen (15) business days following the Draw Date or if the Promoter determines that a Prize-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn. The Promoter is not responsible if the Prize-winner cannot be contacted within fifteen (15) business days after the Draw Date. 

14. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right to the fullest extent permitted by law to: (a) disqualify any Participant; or (b) modify, suspend, terminate or cancel the Promotion, as it deems appropriate.

15. The use of any automated entry software or any other mechanical or electronic means that allows a Participant to automatically enter repeatedly is prohibited and will render all entries submitted by that Participant invalid.

16. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify a Prize, subject to any written directions from a relevant regulatory authority (where applicable).

17. Prize-winners consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Prize(s)

18. There are eight (8) $800 New World Gift Cards to be won (Prizes). 

19. The prize is New World Gift Cards (Prize). Each New World Gift Card can be used to purchase $800 of food or anything else in a participating New World outlet. 20. Prizes, or any unused portion of a Prize, can not be exchanged, negotiated, transferred or redeemed for cash, unless otherwise specified. If the Prize (or any part of a Prize) is unavailable for any reason, the Promoter in its sole discretion reserves the right to substitute the Prize or part of the Prize with a prize of equal value and/or specification.

21. The Promoter’s decision on all matters will be final and no correspondence will be entered into.

Data Protection

22. By entering into the Promotion, the Prize-winner(s) acknowledges that the Promoter may be required to (or may wish to) make a public announcement by print or electronic media, which may include their Personal Information. 

23. The information submitted to the Promoter, and its subcontractors or agents, for the Promotion contains data that allows the Participant to be identified, including name, email address, phone number and delivery address (if required for delivery of a prize) (Personal Information). If a Participant declines to provide their Personal Information, they will not be eligible to participate in the Promotion or receive the Prize.

24. The Promoter, its subcontractors, and agents, will process the Personal Information to administer the Promotion and to notify a Participant if they are a Prize-winner. The Promoter may also use the Personal Information of Prize-winners in social media posts or other media forms from the Promoter. The Promoter will only pass the Personal Information to agents of the Promoter (including outside of New Zealand) in accordance with the Promoter’s Privacy Notice which is available at: www.privacy.elanco.com. 

25. By participating in the Promotion and providing the Promoter with Personal Information a Participant consents to use of the Personal Information and being notified if they are one of the Prize-winners.

Limitation of liability

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Fair Trading Act 1986, as well as any other implied warranties under the Consumer Guarantees Act 1993 or similar consumer protection laws in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any cost, expense, personal injury, loss or damage (including loss of opportunity and loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where such liability may arise out of the following:

(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 

(b) any theft, unauthorised access or third party interference; 

(c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; 

(d) any variation in Prize value to that stated in the Terms and Conditions; 

(e) any tax liability incurred by a Prize-winner or Participant; or 

(f) use of the Prize by a Prize-winner and any accompanying person or any other person.

27. The Participant releases the social media platform(s) and its/their associated companies from all liability arising in respect of the Promotion and acknowledges that: 

(a) the Promotion is in no way sponsored, endorsed or administered by, or associated with, any social media platform; 

(b) any information provided by the Participant in connection with the Promotion is provided to the Promoter and not to any social media platform; and 

(c) any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to any social media platform.

General

28. These Terms and Conditions are governed by the laws of New Zealand and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the courts of New Zealand.
